1) Acceptance of Terms

2) Description of Service

DSS provides an online directory and classifieds platform for software, services, and products relevant to automotive dealerships. Users may post listings via the AWPCP plugin, submit inquiries via our contact form, or communicate by SMS.

3) Eligibility

You must be at least 18 years old and able to form a binding contract to use this site.

4) Accounts & Security

• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for activities that occur under your account.
• Notify us immediately of unauthorized use or security concerns.

5) User Content & Moderation

You retain ownership of content you submit but grant DSS a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as needed to provide the service. DSS may edit, refuse, or remove content at its discretion or where required by law.

6) Prohibited Content & Activities

To keep the site safe and professional, the following content and activities are strictly prohibited and may result in removal of listings, account suspension, or termination without refund:

• Sexual content, including explicit or pornographic material; content that sexualizes minors; escorting or prostitution services; or fetish content.
• Drugs, alcohol, and controlled substances promotion or sale, including illegal drugs, drug paraphernalia, abuse of prescription drugs, or encouragement of underage or irresponsible alcohol use.
• Illegal or prohibited activity (e.g., fraud, counterfeiting, hacking tools, malware, doxxing, harassment, hate speech, incitement of violence, terroristic content, weapons where restricted by law).
• Deceptive, defamatory, or misleading claims, including false advertising, fake reviews/testimonials, or misrepresentation of affiliation.
• IP infringement (copyright, trademark, patent), unauthorized use of confidential or personal data, or violations of privacy and publicity rights.
• Spam and unsolicited outreach that violates CAN-SPAM, CASL, or similar laws.
• Data scraping or automated access that degrades service or violates robots.txt, rate limits, or security controls.

We reserve the right to report unlawful content and cooperate with law enforcement.

7) Classified Listings (AWPCP)

• You must provide accurate information and maintain current details for your listings.
• Listings may be moderated, edited for clarity/format, or removed at our discretion.
• Paid listing and advertising fees are generally non-refundable once processing begins.
• DSS is not liable for loss of business, revenue, or opportunities due to errors, downtime, or visibility changes.

8) SMS & Email Communications

By providing your phone number or email, you consent to receive communications related to your listings, account, or support. You may unsubscribe from marketing emails and opt out of texts by replying STOP. See our Privacy Policy for more details.

9) Intellectual Property

All site content (text, logos, graphics, layouts, and software) is the property of DSS or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the site without prior written consent.

10) Fees, Refunds & Changes

• Pricing, features, and availability may change from time to time.
• Unless otherwise stated, fees are non-refundable once service or processing begins.
• You are responsible for applicable taxes.

11) Disclaimers

The site and services are provided “as is” and “as available” without warranties of any kind, express or implied. DSS does not guarantee uptime, accuracy, or results, and does not endorse third-party content or products.

12) Limitation of Liability

To the maximum extent permitted by law, DSS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities, arising from or related to your use of the site.

13) Indemnification

You agree to indemnify and hold harmless DSS, its owners, and affiliates from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the site, or your breach of these Terms.

14) Governing Law & Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Exclusive venue lies in the state or federal courts located in Salt Lake County, Utah.

15) Changes to Terms

We may update these Terms from time to time. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
